摘　　要：自然资源资产损害是指因破坏、污染和侵占行为导致的全民所有自然资源资产所有者权益损害。对于这种损害,我国目前存在司法救济和行政救济两条路径。“强化自然资源资产损害赔偿责任”包含了“强化私法意义上的权益救济”以及“强化公法意义上的所有者责任”两层法政策思想。要在法体系中贯彻这两层思想,应当强化两条路径的相互协同,形成司法救济和行政救济的相互叠加和组合。为强化私法意义上的权益救济,自然资源资产损害救济应当以司法路径为主,通过专门司法解释完善相应的实体和程序规范。为强化公法意义上的所有者责任,应当对相关自然资源单行法进行修改完善并制定专门的部门规范性文件。Damage to natural resources assets refers to the damage to the rights and interests of owners of natural resource assets possessed by the whole people,which is caused by acts of destruction,pollution and appropriation.To deal with such damages,there exist two paths of remedies currently in China,which are judicial remedy and administrative remedy.“Strengthening the liability for damages to natural resources assets”includes the ideas concerning legal policy in two layers,referring to“strengthening the remedy of rights and interests in the sense of the private law”and“strengthening the owner's liability in the sense of the public law”.To implement these two layers of ideas in the legal system,the mutual synergy of the two paths should be strengthened,forming a mutual superposition and combination of judicial and administrative remedies.In order to strengthen the remedy of rights and interests in the sense of the private law,the remedy for damages to natural resources assets should be mainly based on the judicial path,and the corresponding substantive and procedural norms should be improved and perfected through special judicial interpretation.In order to strengthen the owner's liability in the sense of the public law,the relevant separate laws concerning natural resources should be revised and perfected,and special departmental normative documents should be formulated.
