元宇宙供应商治理:标准与法律融合论的本土化进路

摘　　要：标准与法律之间从关系论迈向融合论需要实然的理论与实践基础。合规构成融合论的理论基础,以合规逻辑治理泛科技化、泛金融化应用场景构成融合论的实践基础。前述泛化特征属于元宇宙发展初期的标志,结合元宇宙相关的技术投入与业态融合已产生实然的治理需求。以元宇宙供应商治理为切入点,通过标准与法律融合实现主体与场景治理,具有认识论与方法论上的现实意义。数字化转型、中国式现代化等外部条件构成融合论的环境动力,标准与法律的工具与价值、定量与定性等可互补构成融合论的本体特征,两者的本土化、透明化与体系化等理念协同构成融合论的认知维度,标准指导的穿透监管、内控责任的合规激励与契约范式的标准嵌入等构成融合论的方法实践,前述四项通过元宇宙供应商治理的样本校验可成为融合论的本土化进路。The transition between standards and statutes from relational theory to coherence theory requires solid theoretical and practical foundations.Compliance constitutes the theoretical basis of coherence theory,and the scenarized governance by compliance approach in the context of technological and financial generalization constitutes the practical basis of the theory.The generalization is a sign of the early stage of metaverse development,and the integration of technology investment and businesses related to metaverse has generated real governance requirements.Taking metaverse suppliers'governance as the breakthrough,launching subjective and scenarized governance through the integration of standards and statutes are of epistemological and method-ological significance.External conditions such as digital transformation and Chinese modernization are the environmental driving force of the theory.The complementarity of standards and statutes in the domain of instrumental and value rationality,quantitative and qualitative regulation,constitute the ontological characteristics of the theory.The concept synergy of localization,transparency and systematization of standards and statutory constitutes the cognitive dimension of the theory.The penetrating supervision under standard guidance,the compliance incentive of internal control responsibility,and the standard application of contractual agreement constitute the methodological aspect of the theory.The four factors can form a local approach to supporting the theory by taking metaverse suppliers'governance as an example.
