论党务信息的认定与公开——以司法裁判为中心的考察

摘　　要：《中国共产党党务公开条例(试行)》仅对党组织“主动公开”党务信息的程序及方式作出规范,却未出现公民、法人或其他组织“依申请公开”的相关规定。因公民、法人或其他组织申请公开党务信息的权限存疑、相关程序阙如、纠纷化解渠道不明,实践中,频繁出现借助《政府信息公开条例》的制度框架来申请党务信息公开之现象。在党务信息公开行政诉讼中,尽管地方法院不乏对实质标准的探索,但最高人民法院倾向于采取以发文字号、制作主体为判断指针的形式标准来认定党务信息,形成了以发文字号标准为主、以主体标准为补充且偶尔回避信息属性认定的司法立场。由最高人民法院的相关案例观之,党务信息的公开存在两种路径:一是认可党务属性与行政属性可能兼容,在此基础上直接适用《政府信息公开条例》实现党务信息公开;二是借助《政府信息公开条例》中的媒介条款,同时结合党内法规中关于党务信息公开的职责条款,间接实现党务信息的依申请公开。The Regulations of the Communist Party of China on the Disclosure of Party Affairs(for Trial Implementation)only regulate the procedures and methods for Party organizations to"actively disclose"Party affairs information,but there are no relevant provisions for citizens,legal persons or other organizations to"disclose upon application".Due to the doubts about the authority of citizens,legal persons or other organizations to apply for disclosure of Party affairs information,the lack of relevant procedures,and the unclear channels for resolving disputes,in practice,the phenomenon of applying for disclosure of Party affairs information according to the institutional framework of Regulations on Disclosure of Government Information has frequently emerged.In administrative litigation on the disclosure of Party affairs information,although there are already some explorations of substantive standards by local courts,the Supreme People's Court tends to adopt formal standards for determining Party affairs information with document symbols and production subjects as judgment guidelines,forming a judicial position that mainly uses document symbol standards,supplemented by subject standards,and occasionally evades the recognition of information attributes.From the perspective of relevant cases of the Supreme People's Court,there are two ways to disclose Party affairs information:first,it is recognized that Party affairs attributes and administrative attributes may be compatible,and on this basis,the Regulations on Disclosure of Government Information are directly applied to achieve Party affairs information disclosure;the second is to indirectly realize the disclosure of Party affairs information upon application with the help of the media provisions in the Regulations on Disclosure of Government Information,together with the provisions on the duties of Party affairs information disclosure in intraparty rules and regulations.
