大湾区流媒体产业融合发展法律风险研究——以中国内地与中国澳门版权法为视角

摘　　要：在粤港澳大湾区的背景下,推动湾区文化市场互联共通离不开以流媒体数字分发为代表的互联网新产业支持,但流媒体数字分发商业模式在极大促进区域间文化消费的同时,也对复制权、合理使用及版权地域保护等传统版权法律制度提出了挑战。虽然这一模式日益成为版权内容传播的重要途径,但不论是澳门地区或是内地现行版权法均未对流媒体数字分发模式做针对性规定,跨域使用方面的规定更是一片空白。这使得版权制度与当前数字版权内容的跨域使用实际严重脱节,给平台方、用户都带来了巨大的法律风险。两地应在未来版权立法中做好协调,针对流媒体数字分发做出专门立法,并尝试在大湾区范围内建立版权内容跨域使用制度,促进湾区流媒体产业的融合发展,推动大湾区单一数字化市场的构建。In the Guangdong-Hong Kong-Macao Bay Area,the interconnection of cultural markets cannot be feasible without new forms of Internet communication such as streaming media.However,while the digital distribution business model of streaming media greatly facilitates the inter-regional cultural consumption,it also challenges traditional copyright law such as the reproduction right,the fair use and regional protection of copyright.Although this mode is becoming increasingly important for the dissemination of copyright content,there is no specific provisions in the current copyright laws of both Macao and the mainland,not to say the cross-domain use of the provisions.This creates a disjunction between copyright system and the cross-domain use of digital copyright and brings a big legal risk to the platform and the users.Therefore,the two places should co-ordinate well in future copyright legislation,introduce special legislation for digital distribution of streaming media,and establish a cross-domain use regime for copyrighted content within the Greater Bay Area,so as to promote the integrated development of the streaming media industry and facilitate the construction of a single digital market in the Greater Bay Area.
