摘　　要：当前中小企业的犯罪形势不容乐观。为了治理企业犯罪,保障民营经济的可持续发展,刑事合规的引入体现了预防企业刑事风险、激励涉罪企业规范行为、改过自新的刑事政策。然而刑事合规在应用过程中仍然存在问题,需要国家进一步采取相关措施,引导、激励民营中小企业采取有效的刑事合规计划,应对刑事风险,促进民营经济健康发展。At present,private enterprises are facing more and more criminal risks.In order to control the enterprise crime and ensure the sustainable development of private economy,the introduction of criminal compliance embodies the criminal policy of preventing the enterprise criminal risk,encouraging the enterprise involved in crime to standardize its behavior and reform itself.However,there are still some problems in the application of criminal compliance,which require the state to take relevant measures to guide and encourage private enterprises to take effective criminal compliance plans,deal with criminal risks and promote the healthy development of private economy.
