摘　　要：知识产权主张实体,俗称“知识产权流氓”。它们是主要通过收购知识产权然后利用诉讼和投诉等救济措施而创造收入的企业或者个人。它们以商业维权、不事创新和不求使用为基本特征。对它们的评价,肯定论及折中论在我国学界较为流行。以正义、创新、效率和发展等知识产权法基本价值为标准,以美国及我国实证材料为基础,它们在根本上是负价值的。它们滥用救济措施,获得不应得的东西,有碍知识产权法的最终目的,不符合正义价值;对创新者激励甚少,抑制被诉企业创新,不符合创新价值;增加交易成本,浪费法律资源,不符合效率价值;背离新发展理念,阻碍实体经济,不符合发展价值。我国应当惩治知识产权主张实体,防止它们阻碍我国“创新驱动发展战略”。Intellectual Property Assertion Entities,commonly known as"Intellectual Property Trolls".They are companies or individuals that generate revenue primarily by acquiring intellectual property rights and then using remedies such as litigation and complaints.They are characterized by commercial enforcement,non-innovation and non-use.The affirmative theory and compromise theory on their evaluation are more popular in China's academic circles.Taking the four fundamental values of intellectual property law,such as justice,innovation,efficiency and development,as the standard of evaluation,and based on empirical materials from the United States and our country,their values are fundamentally negative.They are inconsistent with the value of justice because they abuse remedies,own more than they deserved,and contrary to the ultimate goal of intellectual property law.They are not in line with the value of innovation because they have little incentive for innovators and inhibit the innovation of the accused enterprises.They are inconsistent with efficiency values because they increase transaction costs and waste legal resources.They are not in line with the value of development because they deviate from the new development concept and hinder the real economy.China should punish Intellectual Property Assertion Entities and prevent them from obstructing our"innovation-driven development strategy".
