摘 要:商品房预售制诞生于一个特殊的时点,是中国特色社会主义住房领域市场化改革的重要顶层设计,在过往近30年的大开发时代,它拓宽了开发商资金来源,提高了资金和土地的周转率,加速了商品房供应和城镇化进程,在一定程度上平抑了房价水平,迅速解决(改善)了大部分人的住房生计(条件),对推动房地产可持续发展起了积极作用,但因预先销售的特殊形式及由此产生的交易标的物的不确定性,使其在实践中极易产生纠纷。现如今的房地产已经步入存量房时代,市场运行的底层逻辑也随之转变。恰逢此制甫出至今的香港地区和内地的多年房地产从业经历及由此带来的新变化新趋向新机遇,本文拟从此项制度的历史际遇、利弊得失、存废时机、过渡方案、行业影响、模式演变等方面提供一些历史必然性、现实可行性和未来前瞻性的讨论思路。The pre-sales system for commercial housing was born at a special time point,which is an important top-level design for market-oriented reform in the field of socialist housing with Chinese Characteristics.In the past nearly 30 years of great development era,it widened the source of funding for housing developers,increased turnover of capital and land and accelerated the supply of commercial housing and urbanization.Also it plays a positive role in promoting sustainable development of real estate because it rapidly solved(improved)the housing livelihoods(conditions)of the majority of the population by controlling the housing prices to some degree.However,the special form of pre-sale and the uncertainty of transaction subject matter makes it extremely vulnerable to disputes in practice.Today's real estate is about to enter the era of housing stock and the underlying logic of market operation has also shifted.Coinciding with the years of experience in real estate in Hong Kong and the Mainland since the system was first introduced and the new changes and trends and opportunities brought about by it,this paper intends to provide some historical inevitability,practical feasibility and future prospective discussion ideas on the historical encounter,advantages and disadvantages,timing of existence and abolition,transition plan,industry impact and model evolution of this system.
