摘 要:近年来的市场竞争中消费者机会主义行为层出叠见,且部分已经具有类型化特征,该行为加剧市场信息失灵、致使市场竞争失序、导致责任与利益失衡、损害群体性消费者权益,亟待规制。相比于市场自我调节机制和以民法为代表的私法规制,反不正当竞争法的法律定位和功能发挥机制与消费者机会主义行为规制相契合。然而,我国现行《反不正当竞争法》规制理念和具体制度难以完全满足规制需要。为弥合应然与实然的鸿沟,应在观念层面转变传统认知,正视消费者机会主义行为这一现实问题,同时在制度层面扩围主体制度、填充责任制度。In recent years,the opportunistic behaviors of consumers have emerged repeatedly in market competition,and some of them have been typified,which should be regulated urgently for they aggravate the market information failure,lead to the disorder of market competition,cause the imbalance between responsibilities and interests,and damage the rights and interests of group consumers.Compared with the market self-regulation mechanism and the private law regulation represented by civil law,the legal positioning and function of the anti-unfair competition law is compatible with the regulation of consumer opportunistic behavior.However,the current regulation concept and specific system of anti-unfair competition law in China cannot fully meet the regulation needs.In order to bridge the gap between what it should be and what it is,it is recommended to change the traditional perception at the conceptual level and face up to the real problem of consumers’opportunistic behavior,while expanding the subject system and filling the liability system at the institutional level.
