绿色低碳发展的法治需求与法典化表达

摘　　要：绿色低碳发展是习近平生态文明思想的重要话语表达,具有深厚时代意蕴和鲜明价值导向,内部制度优势和外因发展诉求的相互结合是该政策话语转化为法治话语的基础。通过对绿色低碳发展的实践逻辑进行阐释,明确环境法需要提供以可持续发展为目的标准、以系统性构造为制度指引的法治保障。鉴于既有绿色低碳发展法律规范的体系不足,具有体系化效益的环境法典为之提供了宝贵契机,也为中国环境法增补知识话语、扩大规范范围与革新法律功能起到支撑作用。环境法典应专设“绿色低碳发展编”,在明确基本范畴的基础上,围绕内部构造与外部协调展开编纂:编内要遵循涉碳控制调整的规范范围、经济闭环与新兴制度关照的体系逻辑,以及法律要素实质分析的立法技术;编外需要与其他法律规范有效协调,形成逻辑自足、独立自洽的绿色低碳发展法律体系。Green and low-carbon development is an important discourse expression of Xi Jinping Thought on Ecological Civilization,which has profound characteristics of the times and distinct value orientation,and the combination of its internal institutional advantages and external development demands is the basis for the transformation of the policy discourse into the discourse of the rule of law.By explaining the practical logic of green and low-carbon development,it is clear that environmental law needs to provide legal guarantees with sustainable development as the standard and systematic structure as the institutional guide.In view of the insufficient system of legal norms for green and low-carbon development,the environmental code with systematic benefits provides a valuable opportunity for it to supplement knowledge discourse,expand the scope of norms and innovate legal functions in China’s environmental law.The Code of Environmental Law should set up a special“Green and Low-Carbon Development Compilation”,on the basis of clarifying the basic categories,around the internal structure and external coordination:the codification should follow the normative scope of carbon-related control adjustments,the system logic of economic closed-loop and emerging institutional care,and the legislative technology of substantive analysis of legal elements,and the external needs to effectively coordinate on other legal norms to form a logical self-contained,independent and autonomous green low-carbon development legal system.
