摘　　要：2021年2月24日,A市农业农村局执法人员在对一家兽药生产企业执法检查过程中发现,该企业厂区东南角的库房内有标称某饲料添加剂生产企业生产的4种饲料添加剂,存在未取得生产许可证违法生产饲料添加剂嫌疑。经立案调查,认定当事人违法事实成立,根据《饲料和饲料添加剂管理条例》,自由裁量权适用《××省农业行政处罚自由裁量权基准细则》(饲料部分),依法给予该兽药生产企业行政处罚。本文对案件事实认定、法律适用及行政相对人法律责任认定进行了简要讨论,以期提升执法人员综合执法能力,保障农业投入品质量安全。On February 24,2021,4 kinds of feed additives with the labels indicating production by a feed additive enterprise were found in a warehouse at the southeast corner of the production area of an enterprise producing veterinary drugs by the executive staff of A City Bureau of Agriculture and Rural Affairs,which was suspected of illegally producing feed additives without a permit.Upon investigation,it was determined that the party concerned indeed violated the applicable law,and received administrative penalties in accordance with the Regulations on the Management of Feed and Feed Additives and right of discretion subject to the××Province Agricultural Administrative Penalty Discretionary Power Benchmark Rules(for Feed).The determination of case facts,law application and the determination of legal responsibility of administrative counterparts were discussed in brief,with a view to improving the comprehensive law enforcement ability of executive staff and ensuring the quality and safety of agricultural inputs.
