可持续交通法治:现存问题、价值诉求与实现路径

摘　　要：2021年10月14日在北京召开的第二届联合国全球可持续交通大会使世界认识到交通领域在可持续发展中的关键作用。可持续交通的实现离不开法治的保障。可持续交通法治化存在概念的屈从性、研究的单一性,并缺乏法律体系性保障的问题。根据拉德布鲁赫的法理念的三元价值分析框架,可持续交通的价值可以表示为以迁徙自由为核心要义、以正义运输为应然之义、以交通秩序为底线保障的价值体系。可持续交通法治的实现在宏观上要求推动构建全球交通命运共同体,以实现“双碳”目标为首要任务,坚持陆海统筹以平衡多种运输方式之间的关系;在微观上要求立法上适时制定《中华人民共和国交通运输法典》,司法要考虑增加“交通运输法院”建制,推进“三审合一”的司法审判制度,执法和守法应考虑交通运输生活化的特点。The Second United Nations Global Conference on Sustainable Transportation,held in Beijing on October 14th,2021,brought to the world's attention the critical role of the transportation in sustainable development.Sustainable transportation cannot be achieved without the guarantee of law.The law for sustainable transportation suffers from conceptual subordination,monolithic research and lacks the systemic guarantee of law.According to the triadic value analysis framework of Radbruch's law ideology,the value of sustainable transportation can be expressed as a value system in which freedom of movement is the core value,justice transportation is the right value,and traffic order is the bottom-line guarantee.On the macro level,the realization of the law for sustainable transportation requires the promotion of constructing the community with shared future of the global transportation,taking the realization of the“double carbon”goal as the primary task,adhering to the integration of land and sea to balance the relationship among various modes of transportation;on the micro level,it requires the timely enactment of the Transportation Code of the People's Republic of China in the legislation,and the addition of the“Transportation Court”on the judicial level should be taken into consideration.In the judicial aspect,the establishment of“transportation court”should be considered.The judicial trial system of“three trials in one”should be promoted,and the daily life characteristics in transportation should be considered in law enforcement and law compliance.
