摘　　要：在全面统筹推进知识产权强国建设,提升知识产权创造、运用、保护、管理和服务水平的背景下,专利开放许可制度的落地对改善我国专利实施转化率低的现状具有重要作用。专利开放许可应以实现“效益、公平、秩序”为价值目标,这需要通过细化其适用程序得以实现。目前我国《专利法》仅对该制度作出了原则性规定,适用中仍存在申请条件门槛较低、许可使用费机制有待细化、年费优惠政策不明晰、官方交易平台缺位、专利行政调解缺乏强制性等问题,通过借鉴英国、德国、西班牙等国的经验,提出我国有必要从建立开放专利审查前置程序、完善许可费确立和变价机制、细化年费优惠规则、构建国家统一的智能化交易平台、引入专利行政裁决五个方面进行完善。In the context of comprehensively and comprehensively promoting the construction of a strong intellectual property country and enhancing the level of intellectual property creation,application,protection,management and services,The implementation of patent opening license system plays an important role in improving the low conversion rate of patent implementation in China.The patent licensing system should aim at“efficiency,fairness and order”,which needs to be realized by refining its applicable procedures.At present,The Patent Law of China only provides the principle of this system,which results problems such as low threshold of application requirements,the mechanism of licensing royalty to be refined,unclear policy of annual fee preference,lack of official trading platform and lack of compulsory patent administrative mediation.By drawing on the experience of extra⁃territorial countries such as the UK,Germany and Spain,it is necessary for the patent open licensing system to start from establishing the examination pre⁃procedure,improving the mechanism of establishing and changing the price of license fee,refining the rules of annual fee preference,constructing the only national The patent open licensing system should be improved in five aspects,namely,the establishment of a pre⁃examination procedure,the improvement of the mechanism for establishing and varying licence fees,the refinement of the rules on annual fee concessions,the establishment of a national unique trading platform,and the introduction of administrative rulings.
