专属经济区刑事立法管辖权制度及其完善

摘　　要：《联合国海洋法公约》概括性赋权沿海国对本国专属经济区发生的特定犯罪施以管辖。我国现行立法通过厘定“刑事管辖权空间范围”、刻画“罪状”、设置“罚则”等技术手段对此权力予以规定。囿于立法疏漏及滞后,现行规定已无法满足新时代背景下我国海洋经济高质量发展和海洋法治建设全面推进之诉求。对此,我国专属经济区刑事立法管辖权制度亟待在遵循《联合国海洋法公约》的前提下,选择采取“统一刑法规制为主、附属刑法规制为辅立法模式”,“扩展刑事管辖权空间范围和事项范畴”,“相对精细刻画罪状和较具体设定罚则”等举措予以立法完善。The United Nations Convention on the Law of the Sea(UNCLOS)empowers in generalizability coastal states to exercise jurisdiction over specific crimes committed in their exclusive economic zones.China’s current legislation provides specific provisions for this right by implementing such technological means as defining the“spatial scope of criminal jurisdiction”,characterizing the“facts about a crime”and setting the“penalty”,and so on.Owing to its careless omissions and hysteresis,the current legislative stipulations cannot meet the high-quality development of China’s marine economy under the background of the new era or the appeal of boosting the marine legal construction in an all-round way.And for this,the criminal legislation jurisdiction system of China’s exclusive economic zone urgently needs,under the premise of observing The United Nations Convention on the Law of the Sea,to select such moves as“adopting the legislation model of taking unified criminal law regulation as the principal thing and the auxiliary criminal law regulation as the secondary thing”,“extending criminal jurisdiction scope and space item category”,and“relatively exquisitely depicting facts about a crime and specifically setting penalties”so as to improve the legislation.
