“大综合一体化”行政执法改革背景下乡镇“一支队伍管执法”研究

摘　　要：乡镇“一支队伍管执法”改革作为“大综合一体化”行政执法改革的重要组成部分在实践中面临不少困难和问题。为了更深入地认识这项改革、更好地解决其存在的问题,本文系统梳理了乡镇“一支队伍管执法”的理论依据和法律依据以及过往探索方向,并针对乡镇“一支队伍管执法”实践探索中存在的现实问题,提出了合理委托行政执法具体事项、弹性处理执法职能边界范围、综合施策提升乡镇执法能力、双管齐下搞好乡镇执法监督、以块为主理顺人事管理关系的对策思路。As an important part of reforming the“big-compound-integration”administrative law enforcement,the reform of“one team managing law enforcement”in townships faces many difficulties and problems in practice.In order to have a deeper understanding of this reform and better solve its existing problems,this paper systematically not only sorts out the theoretical basis,legal basis and past exploration directions about the subject matter on town’s“one team managing law enforcement”,but also advances such countermeasures and train of thought as the reasonable entrustment of specific matters of administrative law enforcement,flexible dealing with the boundary scope of law enforcement functions,comprehensive implementation of measures to improve the town’s law enforcement capacity,two-pronged improvement of town’s law enforcement supervision,and rationalization of the relationship of personnel management based on blocks as the principal thing.
