摘 要:“台湾地区与内地地区人民关系条例”作为台湾地区当局规范两岸交流的基础性规定,具有明显的授权性和限制性特征,行政部门据以作出的行政措施难免侵害到两岸居民的权益,台湾地区法院对两岸交流限制性措施的司法规制因而成为一个值得研究的议题。对两岸关系行政案件的考察表明,行政相对人胜诉案件的案件类型和胜诉率具有一定的研究价值,司法对两岸交流限制性措施形成了一定程度的规制,规制方法包括运用经验法则、目的解释方法、法律保留原则等。由于多重原因的影响,这种规制的局限性明显,特别是案件的政治敏感程度容易影响判决的走向。As the basic legislation for Taiwan region authorities to regulate cross-Strait exchanges,the Act Governing Relations between Peoples of the Taiwan region Area and the Mainland Area has obvious authorizing and restrictive features.Administrative measures taken by administrative departments inevitably infringe upon the rights of residents on both sides of the Taiwan region Strait.Therefore,Taiwan regioncourts'judicial regulation of restrictive measures on cross-Strait exchanges has become a topic worth studying.By examining the administrative cases in cross-Strait relations,we find that the types of cases and the winning rate of the plaintiffs have considerable value for research.The judiciary can regulate the restrictive measures of the Taiwan region authorities on cross-Strait exchanges,including the use of empirical rules,teleological method of interpretation,the principle of law reservations and so forth.However,due to the influence of multiple reasons,the limitations of regulation are obvious.It is worth noting that the political sensitivity of the case affects the direction of the judgment to a certain extent.
