互联网医院线上诊疗法律规制问题分析及对策建议

摘　　要：互联网医院将医师、患者、医院和医保等资源高度整合,是助推医疗资源有效共享的关键举措。目前,我国互联网医院线上诊疗服务的类型与范围、相关合同条款以及第三方网络平台责权等尚待明晰,相关法律规制有待进一步完善。笔者建议应理顺互联网医院线上诊疗医方、患方和第三方平台之间的法律关系,在《民法典》与《互联网诊疗监管细则(试行)》相关规定的基础上,进一步明确线上诊疗的类型与范围,完善线上诊疗合同权利义务,防控诊疗风险,强化过程监管等,为打造健康有序安全的线上诊疗体制机制提供参考。The internet hospital highly integrates the resources of doctors,patients,hospitals and medical insurance,which is a key measure to promote the effective sharing of medical resources.At present,the types and scope of online diagnosis and treatment services in internet hospitals in China,relevant contract terms,and the responsibilities and rights of third-party network platforms needed to be clarified,and relevant legal regulations needed to be further improved.The author suggestted that the legal relationship between the online diagnosis and treatment provider,the patient and the platform should be sorted out.On the basis of the relevant provisions of the civil code and the detailed rules for the supervision of internet diagnosis and treatment(trial),it was necessary to further clarify the types and scope of online diagnosis and treatment,improve the rights and obligations of online diagnosis and treatment contracts,prevent and control diagnosis and treatment risks,and strengthen process supervision,to provide reference for creating a healthy,orderly,and safe online diagnosis and treatment system mechanism.
