《渔业劳工公约》与我国相关法律法规的比较研究

摘　　要：《渔业劳工公约》是世界劳工史上里程碑式的公约,将对世界渔业以及我国渔业进步与升级、渔业船员管理与保障、渔业企业经营与发展、渔船设计与建造等各方面产生一系列深远地影响。本文在介绍公约及其内容架构的基础上,梳理统计了《渔业劳工公约》通过以来的进展,在对我国渔业相关法律法规进行总结概括后,对比分析了我国渔业相关法律法规与《渔业劳工公约》的具体条款,总结指出了二者之间的异同,最后从完善渔业船员管理法规、利用商船船员管理体系和加强渔业船员基础保障等三个方面提出了我国应对《渔业劳工公约》的策略,以促进我国渔业船员权益保护与海洋渔业的蓬勃发展。The Work in Fishing Convention is a landmark in the history of world labor,which will have a series of far-reaching implications for the progress and upgrading of the world's fisheries and China's fisheries,the management and protection of fishermen,the operation and development of fishery enterprises,the design and construction of fishing vessels.On the basis of introducing the convention and its content structure,this paper sorts out and counts the progress since the adoption of the Work in Fishing Convention,after summarizing the relevant laws and regulations of China's fishery,it makes a comparative analysis of the relevant laws and regulations of China's fishery and the specific clauses of the Work in Fishing Convention,and points out the similarities and differences between these two.Finally,it puts forward the strategies to deal with the convention from three aspects:perfecting the management regulations of fishery crew,using the management system of merchant seamen and strengthening the basic guarantee of fishery crew,so as to promote the protection of the rights and interests of Chinese fishermen and the vigorous development of marine fisheries.
