未成年学生早恋现象的生理心理与权利分析

摘　　要：早恋概念的出现,与我国过高的法令婚龄有关。国际人权对未成年人“恋爱”的自由权作出了保护,我国《宪法》《民法典》《中华人民共和国未成年人保护法》对未成年人自由权也进行了捍卫。“早恋”现象广泛存在,我们要做的是“疏导”,而不是“去堵”。我国正在走法治化路线,应该保护未成年人的自由权。对于不满14周岁的儿童的早恋应进行劝诫,采取特别的警戒措施;对于已满14周岁未成年人的早恋应坚持“中立”和“保护隐私”两大原则,同时也应加强对青少年的性教育,下调我国法定结婚年龄,与国际接轨。The emergence of the concept of“Early Love”is related to the high age of marriage in China.International human rights protect the free right of minors to“love”,and China s Constitution,Civil Code and Law of the People s Republic of China also defend the free right of minors.The phenomenon of“Early Love”is widespread.What we need to do is to ease rather than block.Our country is taking the route of rule of law and should protect the freedom of minors.For the girl who is not 14 years old,the“Early Love”should be exhorted and special vigilance measures should be taken.The principle of“neutrality”and“privacy protection”should be adhered to for“Early Love”among minors over the age of 14.Meanwhile,sex education should be strengthened and the legal age for marriage should be lowered in line with international standards.
