摘　　要：网络交易并不仅仅是一个把商品交易从线下搬到线上的简单迁移,它带来的是交易双方地位的巨大变化乃至整个商业模式与交易规则的重新构建。互联网平台企业也早已超越传统的“柜台出租者”或“居间人”的地位,在交易实践中形成了兼具市场构建者、市场管理者、信用评价者、用户数据收集与掌控者等多重身份的角色。基于其事实上的多重身份,应当承认和明确平台企业已经具备一定程度的准公共性,进而要求其承担起相应的社会责任,包括公平制订交易规则、中立裁决平台内纠纷、诚信遵守商业道德以及更严格的个人信息保护与数据安全维护义务等。Online trading has made great changes in the status of both transaction parties and even the re-construction of the entire business model and trading rules.Internet platform enterprises have also gone be-yond the traditional position of"counter renters"or"middlemen",and formed multiple identities in transac-tion practice,which include market builders,market managers,credit evaluators,user data collectors and controllers.Based on their multiple identities in fact,it should be recognized and made clear that platform en-terprises have already possessed a certain degree of quasi-publicity,and then they are required to assume cor-responding social responsibilities,including fair formulation of trading rules,neutral adjudication of disputes within the platform,integrity and compliance with business ethics,and stricter personal information protec-tion and data security maintenance obligations,etc,.
