违法一元论与专门矫治教育的完善

摘　　要：新旧违法一元论主张无责之人无损规范期望稳定性或不具有接受规范的能力,而对违法与责任进行一体化理解,无责之人实施刑法上的行为应归属于警察法调整的范畴,而非刑法。我国近些年来的指导性案例则是将无责之人刑法上的行为纳入犯罪成立的判断过程以及强制医疗矫治型保安处分程序化,专门矫治教育虽取代调整收容教养,但本质上依然为行政措施,在实际运行中还存在着公安机关对流窜作案的无责之人采取刑事强制措施于法无据、教育行政管理权过大等问题。为此,专门矫治教育案件应当被纳入“未成年人刑事案件诉讼程序”,实现专门矫治教育司法化。The new and old monism of illegality advocates that the irresponsible person does not damage the expected stability of the norms or has no ability to accept orders from the norms,but carries out an integrated understanding of illegality and responsibility.The behavior of the irresponsible person in the criminal law should belong to the scope of the adjustment of the police law,not the criminal law.In recent years,the guiding case in China is to incorporate the behavior of the irresponsible person in the criminal law into the judgment process of the establishment of the crime and the procedural nature of the compulsory medical correction-type security punishment.Although the specialized correction education replaces the detaining for reeducation system,it is still an administrative measure in essence.In the actual operation,there are still problems,such as,the public security organ takes criminal coercive measures against the irresponsible person who is fleeing to commit the crime without legal basis,and the educational administrative power is too large.To this end,the specialized correction education cases should be included in the "The Procedure of Juvenile Criminal Cases" to achieve judicialization in the specialized correction education.
