摘　　要：我国学界对于侵犯专利权的行为是否应当纳入刑事制裁存在争议。美国和英国不对侵犯专利权的行为提供刑事制裁,主要的大陆法系国家提供。我国台湾地区最初提供,但之后逐步全面废除。欧盟委员会对是否应当提供刑事制裁经历了从提议到废止的过程。鉴于国际条约并未规定应对侵犯专利权的行为提供刑事制裁、各国或地区存在争议、专利权的复杂性与刑事制裁形成矛盾、侵犯专利权的行为容易被侦查且侵权人通常具备赔付能力、侵犯专利权的行为对社会秩序产生不同影响和专利权人之间存在分化的情况,我国未来不应当对侵犯专利权的行为提供刑事制裁。There is a dispute in the academic circles of China as to whether the infringement of patent rights should be included in criminal protection.The United States and the United Kingdom do not provide criminal protection against patent infringements,while mainly civil law countries do.Chinese Taiwan initially provided criminal protection for patent infringement,but it was gradually abolished.The European Commission has gone through a process from proposal to repeal on whether it should provide criminal protection against patent infringement.In view of the fact that international treaties do not provide criminal protection against patent infringement,there are disputes among countries or regions,the complexity of patent rights is in contradiction with criminal sanctions,patent infringement is easy to be investigated and the infringer usually has the ability to pay compensation,the infringement of patent rights has different effects on social order and there is differentiation among patentees.China should not provide criminal protection for patent infringement in the future.
