“纳瓦尔尼”事件的国际法分析及其对中国的启示

摘　　要：“纳瓦尔尼”事件是近年来国际社会关注的重要问题之一,也是禁止化学武器组织面临的重要难题。一旦禁化武组织认定俄罗斯对纳瓦尔尼使用了“诺维乔克”,那么俄罗斯就违反了《禁止化学武器公约》规定的义务,俄罗斯政府也需承担相应的国际法律责任。“纳瓦尔尼”事件对中国有两方面的启示意义,一是要重视《禁止化学武器公约》的解释和适用问题;二是要灵活运用《禁止化学武器公约》的程序规则。In recent years,the case of Alexei Navalny is not only one of the most important issues in interna‐tional society,but also a difficult problem that the Organization for the Prohibition of Chemical Weapons faces.Once the organization affirmed that Russia used Novichok to Alexei Navalny,Russia would violate the obligations stipulated in the Convention on the Prohibition of the Development,Production,Stockpiling and Use of Chemical Weapons and on Their Destruction,the Russian government should undertake the interna‐tional legal responsibilities.There are two inspirations for China from the case of Alexei Navalny.One is to pay attention to the interpretations and applications of the Convention on the Prohibition of the Development,Production,Stockpiling and Use of Chemical Weapons and on Their Destruction,and the other is to apply in a flexible way the procedural rule of the Convention on the Prohibition of the Development,Production,Stockpiling and Use of Chemical Weapons and on Their Destruction.
