摘　　要：采取文献研究法、逻辑演绎法、专家意见法以及归纳总结法等方法,得出明确“公共健康”和“国家紧急状态或非常情况”的含义,以及适当增设药品专利强制许可的启动主体的结论,以使其能在应对重大传染病疫情之时得以真正实施,满足我国公民的健康需求,并可使我国药品得以快速占据世界市场,为我国药品抢占国际市场先河贡献力量。By means of literature research,logic deduction,expert opinion and induction and summary,this paper clarifies the meanings of“public health”and“national emergency or extraordinary situation”,and draws a conclusion that the scope of the initiating subject of compulsory licensing of pharmaceuticals is appropriately broadened.So the compulsory licensing of pharmaceuticals can be implemented in response to major infectious diseases to meet the health needs of Chinese citizens,and enable Chinese drugs to quickly occupy the world market and take the lead in the international market.
