摘 要:法本体的构造在中国传统法文化发展进程中扮演着十分重要的角色。它的演进具有以儒为主、释道为辅、哲理化逻辑化的形式特点以及法不离天、天不离道并日益哲理化、伦理化的内容特征。这首要的是取决于中国古代的生产方式与社会历史条件,同时受逻辑发展与思维方式等影响因素。法本体这种对“天”的眷恋式的演进使传统法文化在发展路向上具有德法共治、王霸并用以及重视环保等优势,同时也存在保守主义、君主专制主义、男权主义、权力本位主义、泛道德主义、泛刑事化等问题。The construction of legal ontology plays an important role in the development of traditional legal culture.Its evolution has the formal characteristics of being dominated by Confucianism and supplemented by Buddhism and Taoism,and being philosophical and logical,and the content characteristics of the law being inseparable from Tian,Tian being inseparable from the Tao,and the law being increasingly ethical.This is determined by the mode of production,social and historical conditions,logical development and mode of thinking in ancient China.The evolution of law noumenon,which is nostalgic for“Tian”,makes the traditional law culture have the advantages of co-rule of morality and law,the combination of Wang and Ba,and the emphasis on environmental protection.At the same time,there are also problems such as conservatism,monarchy despotism,male chauvinism,power departmentalism,pan moralism,and pan criminalization.
