论我国体育行业失信惩戒机制的适用与优化

摘　　要：在体育信用建设不断发展的时期,失信惩戒机制的发展是相应改革能否显现成效的关键。然而,我国体育行业在该机制研究与应用的探索方面尚存在缺陷。在研究领域,相关成果存在全面性与深度不足、分析角度单一等弊病。在应用领域,我国在规范制定上存在效力与内容的双重缺口,在实践成效上存在司法裁判回应消极、社会管理不成体系、道德建设流于形式等问题。改革者应当针对相应弊病,培养体育行业失信惩戒方面正确的观念,从内容与效力上充实相应规范,并构建不同领域彼此支持的实践体系,以实现该机制在体育领域的科学应用与发展。In the prosperous period of sports credit construction,the development of the punishment mechanism for dishonesty is the key factor for the effectiveness of the corresponding reform.However,there are still some defects in the research and application of this mechanism in our sports industry.In the field of academic research,there are shortcomings in relevant achievements,such as insufficient comprehensiveness and single analysis angle.In the field of practical activities,there are two gaps of effectiveness and content in the formulation of norms in our country,and there are some problems in the practical effect,such as the negative response of judicial judgment,the lack of system of social management and formalistic moral construction.In view of the corresponding drawbacks,the reformers should cultivate the correct research view and practice view of the punishment for dishonesty in sports industry,enrich the corresponding norms in terms of content and effectiveness,and build the practice system supporting each other in different fields,so as to realize the scientific application and development of this mechanism in the field of sports.
