民法典是社会治理现代化的法治基石

摘　　要：“在民法的慈母般的眼里,每一个个人就是整个国家”被奉为至理名言,从而在民法典中奠定了民事主体合法权益受法律保护的权利基石,进而人们把《民法典》奉为“公民的权利宣言书”。诚然,民事权利保护是民法典的出发点,也是民法典的落脚点,但这远远不是民法典之所以伟大的全部。从社会治理现代化和法治社会构建的视野,对民法典的社会价值略作管窥,会发现民法典为基层社会治理明确了应该遵循的诸多基本规则,在赋予权利的同时也明确了社会生活的义务底线,民法典也为社会治理现代化和社会治理新格局提供了重要的法治蓝本,民法典中的民事责任承担原则和责任体系使社会治理中责任承担机制有了刚性依据和强制力保障。因此,民法典是推进社会治理现代化、构建法治社会的法治基石,必须正确认识和充分发挥民法典的社会功能,让民法典真正走近群众,实现其社会治理效能,以中华民族5000多年优秀法律文化和鲜活的中国社会实际为根基,使我国的民法典的社会价值更加凸显、社会影响更为深远。The statement that“the civil law with the loving eyes of a mother regards each individual as the whole community”lays the cornerstone for the legal protection of the legitimate rights and interests of civil subjects in the Civil Code,and the Civil Code is often referred to as a“declaration of civil rights”for individuals.However,its social value goes beyond the protection of civil rights.This paper explores the social functions of the Civil Code in the context of social governance modernization and law-based society development.It is argued that the Civil Code defines basic rules for primary-level social governance,grants rights while imposing obligations in social life,and provides a rule-of-law blueprint for modernization and social governance.The civil liability principles and liability system in the Civil Code provide a solid basis for the liability mechanism in social governance,ensuring its enforcement.Therefore,the Civil Code serves as an important foundation for the modernization of social governance and the development of law-based society.It is crucial to properly understand the social functions of the Civil Code and give them full play so that the social governance function of the Civil Code can be fulfilled.With China’s rich legal legacy and the dynamic reality of Chinese society,the Civil Code is expected to bring forth even more far-reaching social values and impacts.
