摘　　要：本文以江西生态文明试验区为例,探讨了生态文明试验区内渎职犯罪司法实践的现状,针对司法实践存在法条之间不协调、渎职犯罪案件分布不均衡、执纪问责与刑事司法衔接不足、刑事处罚总体偏轻、生态法益保护不足等难题,提出了完善刑法之间的协调性、对执法过程实施全方位监管、完善执纪问责与司法衔接机制、适当加重刑罚惩罚、全面适用生态修复非刑罚措施等对策。Taking Jiangxi Pilot Ecological Civilization Zone as an example,this paper discusses the current situation of judicial practice of nonfeasance crime concerning ecological civilization experiment zones.In view of the problems existing in the judicial practice,such as incoordination between laws and regulations,unbalanced distribution of malfeasance cases,insufficient connection between enforcement accountability and criminal justice,light criminal punishment on the whole,and inadequate protection of ecological legal interests,the countermeasures are put forward here:perfecting the coordination among criminal laws,implementing all-round supervision over the law enforcement process,improving the mechanism for connecting the judicial accountability and enforcement,appropriately aggravating the punishment,and fully applying non-penalty measures for ecological restoration.
