铸牢中华民族共同体意识视野下的少数民族习惯法与基层党组织关系研究——以云南红河H县调查为例

摘　　要：少数民族乡村治理区别于其他基层社会治理,有着典型的特点和特殊的要求,这就要求我们要在铸牢中华民族共同体意识的视野下,结合少数民族的特点,针对民族地区历史发展的实际,将少数民族地区的特色治理规范——习惯法与基层党组织发展建设进行有机融合,创新治理方式,找到适合民族地区基层治理的新型路径和方法。文章以云南红河H县作为调查样本,通过对当地习惯法从历史的角度进行系统梳理,找到习惯法与基层党组织关系的变化特点,在新时代进一步对少数民族习惯法与基层党组织的关系进行重构,从而解决民族地区的社会治理问题,推进乡村治理体系与治理能力的现代化建设。Ethnic minority village governance is different from other grassroots social governance,with typical characteristics and special requirements,which requires us to organically integrate the characteristic governance norms of ethnic minority areas,customary law and the development and construction of grassroots Party organizations in accordance with the characteristics of ethnic minorities and the actual historical development of ethnic minority areas under the vision of consolidating the sense of community for the Chinese nation.This paper hope to propose new ways of governance and finds new ways and methods suitable for grassroots governance in ethnic minority areas.This paper takes H County of Honghe County in Yunnan Province as the investigation sample,systematically combs the local customary law from the historical perspective,finds out the changing characteristics of the relationship between customary law and grassroots party organizations,and further restructures the relationship between minority customary law and grassroots Party organizations in the new era,so as to solve the problem of social governance in minority areas and promote the modernization of rural governance system and capacity.
