摘　　要：从《档案法》及其他法律的相关内容看,档案违法行政罚款呈现出实施主体多元、违法行为多样、设定方式多种、幅度大等特点。从区分违法主体,情节轻重、危害结果,教育与处罚相结合,设定方式,与其他处罚方式组合等要素对《档案法》及其他法律中档案违法行政罚款进行比较分析,得出一个基本事实:《档案法》及其他法律在上述所提及的要素中各有不同表现,相互之间可以取长补短,以更好地发挥行政罚款的功能。档案违法行政罚款比较分析的价值体现在:一方面为高效地处理行政罚款管辖权冲突提供了实证;另一方面为科学合理制定档案行政罚款裁量基准提供了新要素。From the relevant content of Archives Law and other laws,the administrative fines for archival illegality show the characteristics of diversified implementation subjects,different illegalities,various setting methods and wide ranges.By comparing and analyzing the administrative fines for archival illegality of Archives Law and other laws from differentiating the illegal subjects,seriousness of the case and harmful consequences,the combination of education and penalty,setting methods and combination with other punishments,we find a fundamental fact that Archives Law and other laws have different performances in the elements mentioned above and they can learn from the strong points of each other to offset their weaknesses,in order to give better play to the function of the administrative fines for archival illegality.The value of the comparative analysis of the administrative fines for archival illegality is reflected in two aspects:one is providing empirical evidence for dealing with the conflict of the administrative fines jurisdiction while the other is providing new elements for the scientific and reasonable formulation of discretion standard for the administrative fines for archival illegality.
