司法介入国际足联腐败问题的实践与理论辨析——《红牌:美国如何成为世界最大体育丑闻的吹哨人》述评

摘　　要：近年来,国际足联腐败问题严重,引起各方重视。美国与瑞士采取联合行动抓捕多名国际足联官员,将国家司法介入国际足联腐败问题的议题推向高潮。肯·本辛格所著《红牌:美国如何成为世界上最大体育丑闻的吹哨人》一书详细披露了美国调查国际足联腐败案件的实践过程,并做了深入的理论分析。通过对该书的述评,着重探究司法介入国际足联腐败案的背景、贡献与走向。美国依据法律从最初的调查过程到委托瑞士警方抓捕、引渡至美国并最终起诉,完成了司法介入国际足联的全过程。其中,腐败行为适用于美国司法属人和事项管辖权,美国司法部门指控行为符合《反勒索及受贿组织法》的相关法条精神,引渡行为符合《相互法律援助条约》和《美国瑞士引渡条约》。治理国际体育组织腐败问题,强化外在法治监管和推进组织善治改革势在必行。In recent years,the issue of corruption in FIFA has become more and more serious,attracting attention from all sides.The US and Swiss have launched a joint operation to arrest several FIFA officials,bringing to a head the issue of national judicial involvement in FIFA s corruption.Ken Bensinger s book titled Red Card:How the U.S.Blew the Whistle on the World s Biggest Sports Scandal written by thoroughly reveals the practice process of investigating the corruption case of FIFA in the United States and makes in-depth theoretical analysis.As a review of the book“red card”,this research focuses on the background,contribution and direction of judicial intervention in the FIFA corruption case,with a review of the book“red card”as the main content.The research indicates that the US completed the whole process of judicial intervention in FIFA from the initial investigation process to the commission of Swiss police to arrest,extradite to the United States and finally prosecute.The occurrence of corruption is applicable to the Personal Jurisdiction and Subject-matter of the US judiciary.The alleged conduct complies with the relevant provisions of The Racketeer Influenced and Corrupt Organizations Act against extortion and bribery.The act of extradition complies with the treaty on mutual legal assistance and the extradition treaty between the United States and Switzerland.This study suggests that it is imperative to deal with the corruption of FIFA and other international sports organizations,strengthen the external legal supervision and promote the reform of good governance of organizations.
