论生态环境保护综合行政执法中的协作

摘　　要：由于生态环境保护的广泛性、复杂性和执法主体的多元性,为提高生态环境保护综合行政执法效能,需要推进行政执法协作。由于立法规范的缺失、协作内容的多样性、协作目标的复杂性等因素影响,在生态环境保护综合行政执法协作过程中仍然存在着权责划分不清晰、协作机制不健全、协作效率不高等问题。生态环境保护综合行政执法协作可分为协助模式和协同模式,不同模式下主体关系和权限存在区别。此外,由于协作规范缺位、权限划分不明、执法目标差异等因素影响,生态环境保护综合行政执法协作中存在着协作纠纷。为此,应当明确线索移送、证据互认、联合执法等协作内容,通过制定权责清单、成立协调机构、规范协作程序等措施推进生态环境保护综合行政执法协作,妥善化解执法协作纠纷,提高执法协作效能,实现生态环境保护的整体性目标。Due to the extensive and complex nature of ecological environmental protection and the multiplicity of enforcement subjects,it is necessary to promote administrative enforcement collaboration in order to improve the effectiveness of comprehensive administrative law enforcement of ecological environmental protection.However,the lack of legislative regulation,the diversity of collaborative content and the complexity of collaborative goals lead to multiple problems in this process,such as unclear division of powers and responsibilities,unsound collaborative mechanism and inefficient collaboration.Collaboration in comprehensive administrative law enforcement for ecological environmental protection can be divided into assistance mode and synergy mode,and there are differences in the relationship and authority of the subjects under different modes.In addition,due to the lack of collaboration norms,unclear division of authority,differences in enforcement objectives and other factors,collaboration disputes arise in comprehensive administrative law enforcement.To this end,collaborative elements such as the transfer of clues,mutual recognition of evidence and joint law enforcement should be clarified.Meanwhile,we should promote the collaboration by formulating a list of powers and responsibilities,establishing a coordinating body and standardising collaboration procedures,so as to properly resolve the disputes,improve the effectiveness of law enforcement collaboration and achieve the goal of overall effectiveness in ecological environmental protection.
