我国地方流域立法的现状审视与完善路径

摘　　要：地方流域立法是国家流域立法的重要补充,是实现地方流域生态环境一体化保护的重要举措。审视地方流域立法现状,其存在立法结构松散失衡,尚未形成流域立法规范体系、立法目的各有考量,无法满足流域立法现实需求、流域管理体制受限,地方流域协同立法进展缓慢等问题,究其原因,主要是地方流域立法路径不成熟,流域利益冲突制约着地方流域协同立法进程。为促进流域生态环境整体、协调保护,地方流域立法应实现体系化、协同化发展。为此,应以流域综合保护为原则搭建地方流域立法规范体系,以流域整体利益为依据明确地方流域协同立法路径,以流域协同治理为目标完善地方流域协同立法机制。最终,以协同性理念为理论基础,以国家流域立法实践为指导,深入推进地方流域协同立法进程,为流域环境的高质量发展提供立法保障。Local watershed legislation is an important supplement to the national watershed legislation and an important measure to achieve integrated protection of the ecological environment of local watersheds.Reviewing the current situation of local watershed legislation,it is found that the legislative structure is loose and unbalanced;and the watershed legislation standard system has not been formed;the purpose of legislation has its own considerations,which fail to meet the actual demand of watershed legislation;the watershed management system is constrained and thus lead to the slow progress in local watershed collaborative legislation.The main reason lies in the immature path of local watershed legislation and the conflict of watershed interests,which restricts the process of local watershed collaborative legislation.In order to promote the integrated and coordinated protection of watershed ecological environment,local watershed legislation should achieve systematic and coordinated development.Therefore,a system should be established based on the principle of comprehensive watershed protection,with a clear path based on the whole benefit of watershed;and an improved mechanism with the goal of watershed collaborative governance.Finally,based on the concept of synergy and guided by national watershed legislation practices,we will further promote the process of local watershed collaborative legislation,providing legislative protection for the high-quality development of the watershed environment.
