行政权力监管元宇宙面临的风险与应对

摘　　要：自2021年下半年以来,元宇宙概念风行于全球的资本圈与舆论界,引起了各国政府与学术界的高度关注。我国行政机关对元宇宙兴起同样给予高度重视,并针对其制定了一系列扶持政策,以求充分发挥元宇宙在数字经济领域的优势。然而,新兴事物通常具有两面性。元宇宙在集合了区块链、人工智能、5G通讯等高新便利技术的同时,也会给行政监管带来风险。国籍淡化、运营缺乏公益性、AI技术霸权化、管理权限私有化等现有技术特性对行政监管的强制性、公益性、优益性、单方性等特征构成了威胁。必须通过健全元宇宙建设的行政立法指引、完善元宇宙建设外围法律监督的方式正确引导元宇宙建设。在保障行政权力正常监管的基础上,实现元宇宙建设促进社会稳定发展、维护人民利益的根本目标。Since the second half of 2021,the concept of meta universe has been popular in the global capital circle and press circles,and has attracted high attention from governments and academic circles around the worldChinese administrative authorities attach great importance to the rise of the meta universe as well,and have made a series of supportive policies in order to give full play to the advantages of the meta universe in the field of digital economyHowever,new things usually have two sidesWhile the meta universe integrates high-tech and convenient technologies such as blockchain,artificial intelligence and 5G communication,it also brings risks to administrative supervision and regulationThe existing technical characteristics,such as the dilution of nationality,the lack of public welfare in operation,the hegemony of AI technology,and the privatization of management authority,pose a threat to the compulsory,public welfare,beneficial and unilateral characteristics of administrative supervision and regulationIt is necessary to guide the construction of meta universe correctly by perfecting the guidance of administrative legislation and the peripheral legal supervisionOn the basis of ensuring the normal supervision and regulation of administrative power,the fundamental goal of promoting social stability and development and safeguarding peoples interests should be realized in the construction of the meta universe.
