摘　　要：平台规则是网络平台秩序形成的基石。“良规善治”是网络平台健康、有序发展的根本保障。但由平台单边制定的“民间软法”杂糅着诸多利益,存在合法性和合理性的双重危机。从平台规则治理来看,基于私法规制的不足,适当引入公法理念,在个案中对平台规则开展司法审查,既能给予平台自治以充分尊重,又能妥善引导平台规则“向善”。在司法审查的过程中,司法机关应秉承对平台自治的尊重,严格审查方式、对象和强度。在审查标准上,通过合法性审查的平台规则还须进一步以比例原则为指导,采取“三阶”递进方式,围绕适当性、必要性和均衡性三个层次,接受合理性审查。Platform rules are the cornerstone of the formation of online platform order"Good rules and good governance"is the fundamental guarantee for the healthy and orderly development of online platformsHowever,these"civil soft laws"unilaterally formulated by the platform are mixed with many interests,and there is a dual crisis of legitimacy and rationalityFrom the perspective of platform rule governance,based on the shortcomings of private law,the concept of public law is appropriately introduced,and judicial review of platform rules is carried out in individual cases,which can not only fully respect platform autonomy,but also properly guide platform rules to be"good"In the process of judicial review,judicial organs should uphold respect for platform autonomy and strictly review the methods,objects and strengthsIn terms of review standards,the platform rules that pass the legitimacy review need to be further guided by the principle of proportionality,adopt a"three-level"progressive approach,and accept rationality review around the three levels of appropriateness,necessity and balance.
