快递服务合同保价条款是格式条款的正当性研究

摘　　要：我国《中华人民共和国邮政法》(以下简称《邮政法》)《中华人民共和国快递暂行条例》等法律法规对快递服务业的保价进行了规定,保价条款形式实质上都与《民法典》的格式条款高度相似,司法裁判在解决涉及保价案件时,亦援用大量相关格式条款规定,但是法律并未明确规定保价条款是否为格式条款。由于理论和实践对此都有较大困惑,文章将以保价条款、格式条款的法律法规和司法裁判案例为基础,从保价条款的成立要件入手分析保价条款、格式条款的有效条件、特点,证明保价条款是格式条款,以解决理论及实践方面存在的困惑。Postal Law and Provisional Regulations on Express Delivery and other laws and regulations stipulate the price insurance of express delivery service industry.The value insured clauses are highly similar to the standard terms of the Civil Code in form and in substance.Judicial adjudication also uses a large number of provisions on standard terms when settling cases involving price insurance,but the law does not make clear whether value insured clauses are standard terms.Due to the great confusion in theory and practice,this paper will be based on the laws,regulations and judicial adjudication cases stipulating value insured clauses and standard clauses,starting from the establishment of value insured clauses,analyze the effective conditions and characteristics of value insured clauses and standard clauses,and prove that value insured clauses are standard clauses,in order to solve the confusion in theory and practice.
