摘　　要：党的二十大确定了我国2035年的总体发展目标,其中包括“基本实现国家治理体系和治理能力现代化”。纵向治理是国家治理的重要层面。在中央的统一领导下,充分发挥地方的主动性和积极性,既是我国宪法划分央地国家机构职权的基本原则,也是我国国家纵向治理体系的独特优势。至2022年3月,《地方组织法》经历了六次修改,未来的国家纵向治理现代化必须继续借助立法健全充分发挥中央和地方两个积极性的制度体系。宪法地方制度条款的立法实施具有多种类型,其中蕴含着宪法与法律的互动关系。强化两个积极性宪法释义的适应性,充分发挥立法的制度形成功能,并推进相关的宪法审查,有助于铸牢国家纵向治理现代化的法治工程,实现党的二十大确定的国家总体发展目标。The 20th National Congress of the CCP set the overall development goals of China by 2035,including“basically realizing the modernization of the state governance system and governance capacity”.Vertical governance is an important aspect of state governance.Under the unified leadership of the central government,giving full play to the initiative and enthusiasm of the local governments is not only the basic principle of dividing the functions and powers of central and local state organs in China’s Constitution,but also the unique advantage of China’s state vertical governance system.By March 2022,the Local Organization Law had undergone six amendments.The future modernization of state vertical governance must continue to rely on legislation to improve the institutional system of the two initiatives.There are certain types of legislative implementation of the local system provisions of the Constitution,including the interactive relationship between the Constitution and the law.Strengthening the adaptability of the constitutional interpretation of the two initiatives,and strengthening the relevant constitutional review will help to build the rule of law project of the modernization of the state vertical governance,and ultimately achieve the overall national development goals set by the 20th National Congress.
