摘　　要：由于资源稀缺和对使用锂离子电池设备需求的增长,锂离子电池越来越多地应用于各行各业中,因此电池元件的回收利用可能在未来发挥越来越大的作用。本文中,笔者对比分析了欧盟、美国关于锂离子电池回收利用的规范,以及中国现行的制度框架和规范政策。由此得知,锂离子电池回收利用规范的中国进路可以是扩大电池生产者责任,明确分配回收责任,对回收外的环节进行适当规制。以此完善中国锂离子电池回收利用的相关做法,为锂离子电池回收利用提供法律保障,提升电池回收利用的法治化程度,配合“双碳”战略目标的实现。Due to the scarcity of resources and the growing demand for equipment using lithium ion batteries,lithium ion batteries are increasingly used in various industries,so the recycling of battery components is likely to play an increasing role in the future.In this paper,the author made a comparative analysis of the European Union and the United States on the recycling of lithium ion batteries,as well as the current institutional framework and regulatory policies in China.It can be concluded that China's approach to lithium-ion battery recycling standards can be to expand the responsibility of battery producers,clearly allocate the responsibility for recycling,and properly regulate the links outside recycling.In order to improve the relevant practices of lithium ion battery recycling in China,provide legal protection for lithium ion battery recycling,enhance the degree of legalization of battery recycling,and cooperate with the realization of the"double carbon"strategic goal.
