摘  要:当下,有关家庭教育令的理论研究与实践发展错位,导致家庭教育令面临形式不统一、法律责任不清晰及适用条件存在争议等问题。这些实践困境不仅加剧了理论冲突,而且制约家庭教育令的现实效果。明确家庭教育令的法律性质是其规范化适用的前提。从国家支持的权利基础看,国家亲权决定了家庭教育令具有强制性和独立性。作为法律性质与程序实现的连接点,现有的法律载体不能体现家庭教育令的本质特征,亦无法实现其特殊价值。民事令状的内在价值与外在形式都与家庭教育令相匹配。以民事令状为视角,家庭教育令制度的程序障碍能够得以厘清。这些程序争议的出现,不仅亟待民事令状制度研究的进一步深化,同时也昭示着民事裁判文书“三足鼎立”的态势向多元化发展的可能。The mismatch between the theoretical research on family education orders and the current situation in practice has resulted in the problems of inconsistent forms,unclear legal responsibilities and controversial conditions of application,which not only exacerbate the theoretical conflict,but will also constrain the practical effectiveness of family education orders.Clarifying the legal nature of family education order is a prerequisite for its normative application.In terms of the right basis of state support,parens patriae determines that family education order is compulsory and independent.As the link between the legal nature and the procedural realization,the existing legal form does not reflect the essential characteristics of the family education order and cannot realize its special value.The intrinsic value and external form of the civil writ are compatible with the family education order.The procedural obstacles to the family education order can be removed by taking the civil writ as a perspective.The emergence of the controversy over the procedure of family education order not only calls for a further deepening of the study of the civil writ system,but also indicates the possibility of diversifying the triadic system of civil adjudication instruments.
