体育技战术创新法律保护问题研究

摘　　要：体育技战术是否应该受到知识产权法保护是一个颇具争议的问题,更是一个值得人们深入探讨的问题。以知识产权法为视角对体育新技战术的实质和特点进行理论阐释,尽管体育新技战术具有人类智力劳动成果的特征,但囿于目前我国《知识产权法》规定之限制,使其不能受到知识产权法的保护。重点分析体育新技战术不受知识产权法保护之理由,并提出相关建议。It is one controversy problem whether sports skills and tactics should be protected by the intellectual property law,and also is one problem for people to deserve a deep exploration.From the perspective of intellectual property law,this paper makes a theoretical explanation for the substance and characteristics of sports new skills and tactics.Although sports new skills and tactics possess the feature of human intellectual labor achievements,due to the limitation of present rules of our Intellectual Property Law,they can't be protected by the intellectual property law.Therefore,the paper focuses on the analysis of reasons why sports new skills and tactics are not protected by the intellectual property law and puts forward some relevant suggestions.
