摘　　要：知识产权保护工作关系国家治理体系和治理能力现代化,关系高质量发展,关系人民生活幸福,关系国家对外开放大局,关系国家安全。近年来,将他人未注册的商标、姓名、企业名称恶意抢注为自己的商标,伪造、变造实验数据,抄袭、拼凑公知技术来提交专利申请等失信行为屡见不鲜,受到越来越多关注。这些行为不仅破坏知识产权确权秩序,挤占知识产权管理资源,而且会进一步引发囤积居奇、滥发警告、恶意诉讼等滥用知识产权行为,严重扰乱市场竞争秩序,妨碍正当生产经营。本文通过搭建知识产权领域企业信用风险分类指标体系,将企业知识产权相关监管信息和信用信息进行充分整合、挖掘和分析,选取试点企业数据对知识产权领域企业信用风险进行试点测算,为实现信用风险的发现、分类、管控,构建完善的事中事后监管体系,为提升对知识产权领域企业的监管效能提供技术支撑。Intellectual property protection is related to the modernization of national governance system and governance capacity,high-quality development,people's happiness,overall situation of the country's opening up,and national security.In recent years,dishonest acts such as maliciously registering others'unregistered trademarks,names and enterprise names as their own trademarks,forging and altering experimental data,plagiarizing and assembling well-known technologies to submit patent applications have become common and attracted more and more attention.These acts not only undermine the order of intellectual property confirmation and occupy intellectual property management resources,but also further lead to hoarding,indiscriminate warning,malicious litigation and other abuse of intellectual property,seriously disrupting the order of market competition and impeding legitimate production and operation.By establishing a classification index system of enterprise credit risk in the field of intellectual property,this paper fully integrates,excavates and analyzes the relevant regulatory and credit information of enterprise intellectual property,selects the data of pilot enterprises to conduct pilot measurement of enterprise credit risk in the field of intellectual property,in order to provide technical support for realizing the discovery,classification and control of credit risk,building a perfect supervision system during and after the event,and improving the regulatory effectiveness of enterprises in the field of intellectual property.
