立法解释制度功能的历史演进与新时代转型

摘　　要：通过综合分析立法解释制度功能的规范历程与实践变迁可以发现,其历史演进主要表现为两个方面。一是补充法律规定功能的确立、废止与长存。规范上的废止源自于学界关于法律解释有别于立法的理论批判,实践中的长存植根于哲学诠释学关于解释本质上是一种创造性行为的理性判断。二是明确界限功能与统一法律适用功能的角色转换。在规范层面,明确界限是立法解释制度的主要功能;在实践层面,明确界限转变为统一法律适用的主要方法。在我国宪法迈向合宪性审查的新时代背景下以及区分独立型立法解释与辅助型立法解释的理论前提下,立法解释制度可以发挥增强合宪(法)性审查说理性以及法律合宪性事后控制的新功能。为促进立法解释制度功能的全面与有效发挥,应建立健全立法解释制度与合宪性审查、法律修改等相关制度的衔接联动机制。Based on a comprehensive analysis of the norm and practice of the legislative interpretation system,its function has undergone two changes.Firstly,the function of supplementary legal provisions has experienced the development of establishment,abolition and long-term existence.Because the theoretical criticism on the difference between legal interpretation and legislation,lawmakers abolished it.The long-term existence in practice is rooted in the rational judgment of philosophical hermeneutics that interpretation is essentially a creative act.Secondly,the role transformation between the function of clarifying boundaries and the function of unifying the application of law.At the normative level,clarifying boundaries is the main function of the legislative interpretation system.At the practical level,clarifying boundaries becomes the main method of unifying the application of law.Under the background of the new era of China’s constitutional review and the theoretical premise of distinguishing independent legislative interpretation system and accessory legislative interpretation system,the legislative interpretation system can play a new role in enhancing the rationality of constitutional review and the post-control of legal constitutionality.In order to promote the comprehensive and effective function of the legislative interpretation system,we should establish and improve the linkage mechanism between the legislative interpretation system and the constitutional review,legal revision and other related systems.
