摘 要:数字时装秀是时尚行业顺应数字经济浪潮而生的产物。将数字时装秀纳入著作权法的保护范围,契合立法目的、满足保护要件,有利于保障数字时装秀主办单位的正当权利,优化时尚行业营商环境。通过比较分析方法,在借鉴法国、英国关于时装秀保护模式的基础上,探求我国数字时装秀受著作权法保护的具体类型及权利主体。从选择编排阶段而言,数字时装秀构成汇编作品;从拍摄录制阶段而言,以数字时装秀呈现的艺术效果为判断独创性高低的标准,构成视听作品或录像制品。数字时装秀属于视听作品时,主办单位是著作权主体;数字时装秀属于录像制品时,主办单位和模特分别作为录制者和表演者,均是邻接权主体。该研究可为完善我国数字时装秀著作权保护制度、推动时尚行业创新发展提供有益思路。Digital fashion shows are the product of the fashion industry′s response to the wave of the digital economy.The inclusion of digital fashion shows into the scope of protection of the Copyright Law is in line with the purpose of the legislation and meets the elements of protection,which is conducive to protecting the legitimate rights of the organizers of digital fashion shows and optimizing the business environment of the fashion industry.Through the method of comparative analysis,we explore the specific types of digital fashion shows protected by copyright law and the subjects of rights in China on the basis of the model of protection of fashion shows in France and the UK.From the stage of selecting and arranging,the digital fashion show constitutes a compilation work;from the stage of filming and recording,the artistic effect presented by the digital fashion show is the criterion for judging the level of originality,which constitutes an audio-visual work or a video product.When the digital fashion show is an audiovisual work,the organizer is the subject of copyright;when the digital fashion show is a video production,the organizer and the model,as the video producer and performer respectively,are the subjects of neighboring rights.The study can provide useful ideas for improving the copyright protection system of digital fashion shows in China and promoting the innovative development of the fashion industry.
