摘 要:【目的】随着人工神经网络、深度学习等机器学习算法的逐渐成熟,人工智能生成成果与人类创作作品在外观上并无差别,通过对“独创性”这一核心要素进行剖析,积极应对人工智能生成成果可否获得作品资格认定并受到著作权保护的难题。【方法】比较分析作者权体系和版权体系国家独创性标准的理论基础及司法实践,为我国独创性判断标准的选择提供思路。【结果】在当前传统人格理论不断受到冲击的背景下,应当采取独创性客观标准。【结论】基于对人工智能创作效率和我国著作权体系建设的考量,适当提高客观标准的创作高度,更有助于人工智能产业长期良性发展。[Purposes]With the gradual maturation of artificial neural networks,deep learning and other machine learning algorithms,there are no differences in appearance between AI generated works and those created by humans.The core element of“originality”is analysed in order to positively address the challenge of whether the contents generated by artificial intelligence can be qualified as works and protected by copyright.[Methods]Compare the theoretical basis and judicial practice of the originality standards in the countries with authorship and copyright systems,and provide ideas for the selection of the criteria for judging originality in China.[Findings]Against the background that the traditional personality theory is constantly under attack,the objective criterion for originality should be adopted.[Conclusions]Based on the consideration of the efficiency of AI creation and the construction of copyright system of China,It is conducive to the long-term positive development of AI industry to raise the bar of the objective criterion for creation appropriately.
