摘 要:随着刑事立法不断扩张,导致大量的行政不法行为被犯罪化,刑法的自由保障机能被严重弱化。非罪化理论承袭自由主义思想,是对刑法犯罪化的重要调适。一般而言,非罪化包括立法机关非罪化、司法机关非罪化和监察机关非罪化三种实践形态。基于行政犯罪案件的特殊程序构造,事实上,行政执法机关亦享有非罪化的权能。行政执法机关非罪化具有主体的特定性、依据的隐晦性、对象的特殊性、替代处罚措施的完备性以及过程的封闭性等特征,其本质仍属于行政权范畴,是非罪化理论的重要发展。With the expansion of criminal legislation,many administrative wrongful acts have been criminalized,and the freedom protection function of criminal law has been seriously weakened.The theory of decriminalization inherits liberal ideas and is an important adjustment to the criminalization of criminal law.Generally speaking,the practice of decriminalization includes decriminalization of the legislature,decriminalization of the judiciary and decriminalization of the supervisory organs.Based on the special procedural structure of administrative crime cases,administrative law enforcement organs also have the power to decriminalize.The decriminalization of administrative law enforcement organs has the characteristics of the specificity of the subject,the obscurity of the basis,the particularity of the target,the completeness of alternative punishment measures,and the closedness of the process,and its essence still belongs to administrative power,which is an important development of the theory of decriminalization.
