法治末梢中的乡镇司法所--围绕司法行政职能展开的考察

摘　　要：乡镇司法所在全面依法治国进程里,发挥着基础却不可替代的作用。作为法治建设的末端载体,乡镇司法所的职能长期以来都较为薄弱。通过纵向观察与横向比较发现,职能之弊的根本原因是体制机制不畅。2018年党和国家机构改革后,司法所的体制机制有了明显改进。乡镇司法所职能呈现出党政融合的特征,并以法治建设为核心得到强化,其职能的现实运行也围绕法治建设进行转向。但当前乡镇司法所的职能发挥仍面临诸多挑战,为夯实法治中国的末梢建设,需要实现政治引领性与行政制度性在乡镇司法所职能行使中的协调统一,推动乡镇司法所职能安排与行政效能的科学匹配,注重乡镇司法所职能发挥与社会参与的有机结合,充分发挥乡镇司法所在国家治理现代化中的应有功能。Township judicial administrative office plays a fundamental but irreplaceable role in the process of governing the country comprehensively by law.As the terminal carrier of the construction of the rule of law,the function of the township judicial administrative office has been weak for a long time.Through vertical observation and horizontal comparison,the root cause of functional disadvantages is that the system mechanism is not smooth.Since the reform of Party and state institutions in 2018,the system and mechanism of township judicial administrative offices have been significantly improved.The functions of the township judicial administrative office show the characteristics of the integration of the Party's leadership and the operation of the administrative power.The construction of the rule of law as the core has been strengthened,and the practical operation of its functions has also been transformed around the construction of the rule of law.However,the current functioning of the township judicial administrative office still faces many challenges.In order to consolidate the construction of the end of the rule of law in China,it is necessary to realize the coordination and unification of political guidance and administrative system in the exercise of the functions of the township judicial administrative office,and promote the scientific matching of the function arrangement and administrative efficiency of the township judicial administrative office.We should attach importance to the organic combination of the function of township judicial administration office and social participation,and give full play to the due function of township judicial administration office in the modernization of national governance.
