摘　　要：对标RCEP经贸规则,是构建中国特色自贸港政策制度体系的重要内容,也是以高水平开放促进自贸港高质量发展的法治化保障要求。海南建设中国特色自贸港,核心在于构建开放型经济的法治保障机制。实施RCEP经贸规则,重在推进自贸港国际化、市场化、法治化发展机制。RCEP已是自贸港高水平开放的新标杆。推动制度集成创新是自贸港实现高质量发展的法治创新焦点,更是自贸港法规体系的重要构成部分。国际化发展的法律定位,是实现以高水平开放促进自贸港高质量发展的法治保障。自贸港法规制定权的运用,既要与RCEP规则相衔接,又要注重符合中国特色和海南实际情况,兼顾“入乡随俗”的法治本土化。Benchmarking RCEP economic and trade rules is an important part of building a policy and institutional system for free trade ports with Chinese characteristics,and also a legal guarantee requirement for promoting high-quality development of free trade ports through high-level openness.The core of building free trade ports with Chinese characteristics in Hainan lies in building a legal guarantee mechanism for open economy.The implementation of RCEP economic and trade rules focuses on promoting the internationalization,marketization,and legalization development mechanism of free trade ports.RCEP has be-come a new benchmark for the high-level opening up of free trade ports.Promoting institutional integration innovation is the focus of legal innovation for achieving high-quality development of free trade ports,and is also an important component of the regulatory system of free trade ports.The legal status of international development is the legal guarantee for achieving high-quality development of free trade ports through high-level openness.The application of the right to enact laws and regulations of free trade port should not only be in line with the RCEP rules,but also pay attention to conform to Chinese characteristics and the actual situation of Hainan,while also taking into account the localization of the rule of law of“doing as the Romans do when in Rome”.
