版权保护背景下数字音乐产业发展问题

摘　　要：数字音乐产业是当今音乐市场的中流砥柱。随着流媒体技术的发展,数字音乐展示出了其无与伦比的优势。但在繁荣的背后,中国数字音乐产业在产权保护方面暴露出了诸多问题。一方面,版权人饱受侵权行为的困扰,现有的版权保护体系很难完整地保护版权人的各项权益;另一方面,版权本身也存在着被滥用的倾向,使其难以发挥自身的作用。以保护版权与深耕版权资源作为方向,借鉴国外制度经验,着眼于法规、技术和集体组织制度角度提出有关版权保护与开发的设想与建议。The digital music industry is the mainstay of the music market.As the development of streaming,the music market has achieved its growth and has played its unparalleled advantage.But China’s digital music industry has exposed many problems behind the prosperity.From the perspective of copyright protection,copyright owners are plagued by infringement.The existing copyright protection system was difficult to protect the rights and interests of copyright owner.On the other hand,copyright itself had the tendency to be abused,making it difficult to play its own role.Suggestions for copyright protection and development are proposed,including drawing on the experience of foreign systems and focusing on regulations,technology and collective organizations systems.
