摘　　要：本文通过分析节能环保涉案专利及专利诉讼情况,构建中国节能环保涉案专利数据库,结合诉讼文书进行法律信息标引,利用统计分析、案例分析对涉案专利、专利诉讼情况开展研究,通过将专利分析与诉讼案件创造性结合,得出我国节能环保产业专利诉讼案件数量偏低,诉讼类型以侵权诉讼为主,诉讼案件量处于动态增长阶段,东部地区涉案专利及诉讼案件量较大的结论。基于研究结论,提出提升专利保护意识,充盈专利律师,构建大保护格局的建议,为节能环保企业制定相关知识产权保护战略提供参考。This paper analyzed the situation of patents involved in energy conservation and environmental protection and patent litigation,built the database of patents involved in energy conservation and environmental protection in China,conducted legal information listing combined with litigation documents,and carried out research on patents involved and patent litigation by using statistical analysis and case analysis.Through the creative combination of patent analysis and litigation cases,it concluded that the number of patent litigation cases in China’s energy conservation and environmental protection industry was low.The type of litigation was mainly infringement litigation,and the litigation case volume was in a dynamic growth stage.The conclusion was that the patents involved in the eastern region and the litigation case volume were relatively large.Based on the research conclusions,suggestions were put forward to enhance the awareness of patent protection,fill patent lawyers,and build a large protection pattern,which can provide reference for energy conservation and environmental protection enterprises to formulate relevant intellectual property protection strategies.
