摘  要:优等悬赏广告在民事活动中的运用愈加频繁,但在我国民事立法缺位的情况下,悬赏人滥用优势地位,应征人得不到充分保护的情况时常发生。此种情况下,法教义学应该有所作为,为应征人争取利益。相比起单方行为说,合同说在现代模式下的优等悬赏广告中有更强大的解释力。在合同正义的指导下,对于优等悬赏广告合同成立以及生效时间点的实质取决于广告法律性质的确定,而对于性质确定的出发点应该在强化应征人的法律地位上。为保护应征人合法利益,落脚点为建议我国最高人民法院以合同说为理论基础在司法解释中对优等悬赏广告的性质进行确定。Selective bounty advertisements are used more and more frequently in civil activities,but in the absence of civil legislation in our country,it often happens that bounty sponsors abuse their dominant positions and applicants are not adequately protected.In this case,Legal dogmatics should do something to fight for the interests of the applicants.Compared with the theory of unilateral behavior,the theory of contract has a stronger explanatory power in the modern mode of premium reward advertisements.Under the guidance of contract justice,the essence of the establishment of a premium reward advertisement contract and its effective time depends on the determination of the legal nature of the advertisement,and the final point of the determination of the nature should be to strengthen the legal status of the applicant.In order to achieve the purpose of protecting the legitimate interests of applicants,it is suggested that the Supreme Court should use the contract theory as the theoretical basis to determine the nature of the superior reward advertisement in the judicial interpretation.
