摘　　要：实用新型专利在我国专利保护体系中发挥着独特的作用,在实用新型专利申请的初步审查中会对专利法第2条第3款所规定的实用新型专利保护客体进行审查,如何更有效地答复相关审查意见是值得思考的问题。该文梳理了我国在各个时期对实用新型专利保护客体的相关规定,从复审和无效案例出发,对实用新型专利保护客体的审查原则和答复思路进行了分析,希望通过以上的案例分析,明晰审查思路,梳理答复要点,为涉及实用新型专利保护客体的审查意见答复提供实务操作建议。Utility model patents play a unique role in the patent protection system in China.In the preliminary examination of utility model patent applications,the examination of the utility model patent protection object stipulated in Article 2,Paragraph 3 of the Patent Law will be conducted.How to respond more effectively to relevant examination opinions is a question worth considering.By combing through the relevant provisions on the utility model patent protection object in China at different periods,starting from the reexamination and invalidation cases,this paper analyzes the examination principles and response ideas of the utility model patent protection object,and hopes to clarify the examination ideas and sort out the key points of responding to patent examination opinions through the above case analysis,and provide practical operation suggestions for responding to opinions involving utility model patent protection objects.
